The Supreme Court is split on whether to repeal some of the executive actions put forth by President Barack Obama on immigration during his tenure.
Chief Justice John Roberts and Samuel Alito questioned the language in the administration's guidance, which they suggest would contradict the immigration law.
"How is it possible to lawfully work in the United States without lawfully being in the United States?"
Alito asked.
Liberals on the bench appeared more sympathetic to administration's rhetoric.
Justice Ruth Bader Ginsberg noted there are 11.3 million undocumented aliens in the country and Congress has provided funds for removing about four million.
"So inevitably, priorities have to be set," she said.
